Gradewise Terms and Conditions

Welcome to Gradewise! These Terms and Conditions ("Agreement") govern your access to and use of the Gradewise mobile application and website (collectively, the "Service"). By accessing or using our Service, you agree to this Agreement and our Privacy Policy.
1. Description of Service
Gradewise provides educational content for students, allowing practice and improvement in various subjects. Users can access free content supported by ads or purchase premium features.
2. Eligibility and Registration
Gradewise does not allow children under the age of 13 to create their own accounts. A parent or legal guardian must create and manage all accounts. Child profiles are created and managed under parent accounts.
3. Premium Features and Billing
Gradewise offers premium features through a one-time payment valid until June 30, 2025. Premium features are activated per child profile, meaning each child profile requires a separate purchase. The premium payment is non-refundable once completed.
Monthly, quarterly, or yearly subscription models will be introduced shortly. Subscription details, including auto-renewal, cancellation policies, and associated terms, will be provided at the time of launch.
4. Account Responsibilities
You agree to provide accurate information when creating your account and managing child profiles. You are solely responsible for maintaining confidentiality and security of your account credentials and all activities under your account.
5. Intellectual Property Rights
Gradewise content, software, graphics, user interfaces, text, and educational materials are protected by intellectual property laws. You may not copy, distribute, modify, or create derivative works without explicit permission from Gradewise.
6. User Conduct and Content
You agree not to misuse the Service, upload inappropriate content, or attempt unauthorized access. Gradewise reserves the right to terminate accounts that violate these terms.
7. Advertising
Gradewise uses Google AdMob for ads in the free version of the Service. Gradewise does not share personal child profile information with third-party advertisers.
8. Privacy and Data Security
Gradewise respects user privacy and handles data according to our Privacy Policy. Parents can request deletion of their child's data by contacting support@gradewise.com.
9. School and Educational Institution Usage
Schools or educational institutions using Gradewise must comply with applicable laws such as FERPA and COPPA and are responsible for obtaining required parental consents.
10. Modifications to Terms
Gradewise reserves the right to update these terms periodically. Significant changes will be communicated through the Service or via email to registered users.
11. Disclaimer of Warranties
Gradewise is provided "as is." We do not guarantee uninterrupted, error-free, or secure use of the Service.
12. Limitation of Liability
To the fullest extent permitted by law, Gradewise will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use or inability to use the Service.
13. Indemnification
You agree to indemnify and hold harmless Gradewise from claims arising out of your violation of these terms, misuse of the Service, or infringement of intellectual property.
14. Governing Law and Arbitration
These terms are governed by laws of the State of Georgia. Any disputes will be settled through binding arbitration conducted in Atlanta, Georgia.
